Critical Dune Designated Areas

Manistee County has acreage that is considered Critical Dune Designated and/or High-Risk Erosion as defined by the Michigan Department Environmental Quality. The adoption of the Critical Dune Area program by the State of Michigan protects Michigan’s fragile and unique coastal sand dunes by promoting the use of design and construction techniques that minimize the impact in dunes areas. High-Risk Erosion Areas identifies historically eroding areas and establishes setback requirements that promote safer locations for new construction within these areas.

With the adoption of the Atlas of Critical Dune Areas in February of 1989 by the State Legislature, applicants seeking a Critical Dune permit are required (as a part of the permit application process) to obtain a “Vegetation Letter of Assurance” from the local Conservation District. Guidelines that govern the requirement of permits are “as defined in Part 353, Sand Dunes Protection, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (NREPA), “use” means “a development, silvicultural, or recreational activity done or caused to be done by a person that significantly alters the physical characteristic of a critical dune area or a contour change done or caused to be done by a person”. A DEQ permit is required for any use within a Critical Dune Area. Regulated Activities include construction of buildings and additions, installation of septic systems, water wells, driveways, all excavation, filling, sand removal, and vegetation removal within Critical Dune Areas. Sand removal includes clearing streets, parking lots, and recreational areas in privately and publicly owned properties.” Additional information concerning Critical Dune Areas is outlined at the Michigan DEQ's web site.
